By accessing cemastea.ac.ke and the digital services offered through it, you agree to the terms below. They form a binding agreement between you and CEMASTEA. Please read them in full; if you do not accept them, discontinue use of the website.

1. About these terms

These Terms of Use ("Terms") form a binding agreement between you and the Centre for Mathematics, Science and Technology Education in Africa ("CEMASTEA"), a State Corporation established under Legal Notice No. 41 of 2014. They apply to cemastea.ac.ke, every sub-domain we operate, our staff portal, and any resource we publish through those channels.

2. Permitted use

You may browse the website and download the resources made publicly available for your personal, non-commercial, and educational use, provided that you:

Preserve attribution

Do not remove any copyright, trademark, or proprietary notice from the material you download or share.

Honour authorship

Do not represent yourself as the author or originator of material produced by CEMASTEA or its contributors.

Use respectfully

Do not use the material in a manner that disparages CEMASTEA, the Ministry of Education, or the Government of Kenya.

Cite the source

Acknowledge CEMASTEA as the source when republishing extracts in academic, journalistic, or training work.

3. Intellectual property

All content on this website — including text, graphics, logos, icons, photographs, videos, downloadable documents, software and their arrangement — is the property of CEMASTEA or its licensors and is protected by the Copyright Act, 2001 (Cap. 130) and the Trade Marks Act (Cap. 506) of the laws of Kenya. No part of this website may be reproduced, distributed, or transmitted for commercial purposes without the prior written consent of CEMASTEA. The "CEMASTEA" name and mark, the Government of Kenya coat of arms, and the SMASE-Africa identifier are protected marks and may not be used without authorisation.

4. Prohibited conduct

You shall not:

  • attempt to gain unauthorised access to any part of the website, the staff portal, or the servers on which they are hosted;
  • probe, scan, or test the vulnerability of the website, or breach any security or authentication measure;
  • upload, submit, or transmit any material that is unlawful, defamatory, harassing, obscene, or infringing of any third party's rights;
  • use the website to distribute malicious software, conduct phishing, or engage in any activity that is, or would be, an offence under the Computer Misuse and Cybercrimes Act, 2018;
  • misuse our forms, email addresses, or newsletter channels to send unsolicited communication or spam.

5. User submissions

Where you submit information to us through a form, a partnership proposal, a support request, or any similar channel, you warrant that the information is accurate, that you have the right to share it, and that it does not infringe any third-party right. CEMASTEA may retain, reproduce, and act on submissions in line with the Privacy Policy and applicable law.

6. Third-party links

The website may contain links to sites operated by our development partners, government counterparts, or third parties. CEMASTEA does not control those sites and is not responsible for their content or practices. A link does not imply endorsement.

7. Availability and accuracy

We strive to keep the website available and the information on it accurate and current. However, the website is provided "as is" and we make no warranty that it will be uninterrupted, error-free, or that any defect will be corrected. Where information on this site conflicts with an official CEMASTEA document — a tender notice, a published policy, a gazetted instrument — the official document prevails.

8. Limitation of liability

To the fullest extent permitted by law, CEMASTEA shall not be liable for any indirect, incidental, consequential, or exemplary loss arising out of your access to, or inability to access, the website or the use of any content obtained from it. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

9. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms shall be referred first to good-faith negotiation between the parties. Failing resolution within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the courts in Nairobi.

If you believe a service provided through this website falls short of the standards set out in our Service Charter, please raise it through the feedback and redress channels there before escalating.

10. Changes

CEMASTEA may amend these Terms from time to time. The revised Terms take effect from the date they are posted on this page. Continued use of the website after an amendment signifies acceptance of the revised Terms.
